In a startling turn of events, two US lawyers and their law firm, Levidow, Levidow & Oberman, have been fined $5,000 after submitting fake court citations generated by ChatGPT, an AI-powered chatbot. The fines were imposed by a district judge in Manhattan, who emphasized the need for accuracy and responsibility in the use of artificial intelligence for legal work.

Steven Schwartz and Peter LoDuca, the lawyers involved, admitted to relying on ChatGPT to create fictitious legal research for an aviation injury claim against the Colombian airline Avianca. The chatbot invented six cases, which were then incorporated into a legal brief. However, the deception did not go unnoticed, and the judge took a stern stance, asserting that lawyers must be vigilant in ensuring the accuracy of their filings, even when leveraging AI tools.

The law firm, Levidow, Levidow & Oberman, stated that they respectfully disagreed with the court’s judgment and claimed that the fake citations were an unintentional error. They expressed surprise that a technology like ChatGPT could fabricate cases with such convincing detail.

ChatGPT, developed by the US firm OpenAI, is known for generating plausible text responses to human prompts. However, it is not infallible and can sometimes produce erroneous information or even make up non-existent scenarios. In another example, ChatGPT falsely accused an American law professor of sexual harassment, citing a nonexistent news report.

The incident has raised questions about the limitations of AI tools and the responsibility of lawyers in verifying the accuracy of information they present in court. While AI can be a powerful tool for assisting legal work, it should be used with caution, and human oversight is essential to prevent the spread of misinformation.
